There are a number of crimes nowadays where you are automatically assumed to be guilty de facto if not actually assumed guilty du jure. Of these are sexual harrassment (if the victim is female and the accused is male), rape (same situation), anything related to terrorism, hate crimes, and drunk driving.
Actually, with regards to things like terrorism and drunk diving, you can be proven to not having broken the law and still be whisked away to jail or a detention center.
Take a look at the great state of Arizona, home of some of the toughest DUI laws in the country. In fact, they’re so tough that even though you blow under the legal limit, you can still be taken to jail on DUI over the limit and have the opportunity to be dragged off to jail in front of your kid and shell out $12,000 in legal fees just to get the charges dropped.
Just remember, if you get pulled over, assume that the police are just aching to bust you for something. It may not be true, but it will get you in the right frame of mind.
Be polite, but don’t allow them to trample all over your rights. Don’t lie to them, but never offer them any information that they may use later on. If you’re on pain medication, even if the last one you had was eight hours ago, don’t offer up that information to the officer. Never reach for your drivers license or insurance until specifically asked. Having them ready for the officer isn’t a good idea since both of those things can look like reaching for a weapon. Just keep your hands on the wheel until the officer asks you otherwise.
